  • 1. General

    a) In these conditions the ‘Seller’ means Appliance Trader Ltd trading as ‘Eastleigh Services’.
    b) The ‘Buyer’ means the Company, Firm or Person who places an order with the seller or otherwise agrees to buy from the seller any of the goods or services offered.
    c) The ‘Goods’ and or ‘Services’ shall mean all or any of the Goods and or Services such as installation, labour etc., which the seller offers for Sale and Service which form the subject matter of the contract.
    d) The ‘Contract’ shall mean the Contract on the terms of these Conditions for the sale from the seller to the buyer of any of the goods and services as outlined above, and as detailed in any written Quotation.
    e) The Seller reserves the right to withdraw from supplying goods or services as detailed in any written quotation prior to supply taking place.

    2. The Sellers Conditions

    These Terms and Conditions shall apply to the Contract entered into by the Seller to the exclusion of all other Terms and Conditions whether express or implied, no variations or additions to these Terms and Conditions shall be binding upon the seller unless expressly accepted by the seller in writing under the hand of an authorised official of the seller.

    3. Acceptance

    Unless previously withdrawn Quotations and Tenders are open for the period stated therein, or if no period is stated then within 30 days from the date thereof.  Orders must be accompanied by sufficient information to enable the Seller to proceed without delay with the execution of the order.  Orders shall not be binding on the Seller unless accepted by the Seller in writing and made subject to these conditions.

    4. Price and Price Variation

    Prices charged and discounts given will be those detailed on the quotation or sales order. Eastleigh Services reserve the right to change prices in line with suppliers price increases without prior notice. Current at the date of delivery.  Prices quoted will exclude delivery and Value Added Tax unless stated as included on the Quotation, Acceptance document or receipt. We make every effort to ensure prices are correct at the time of print; never the less we reserve the right to change prices without prior notification. Or if necessary withdraw goods from sale at any time.

    5. Warranty and Guarantees

    Sales: Manufacturers warranty terms apply unless otherwise stated on the seller’s quotation or sales documentation.  A copy is available on request. The Buyer shall give the Seller immediate written notice of any claim that the goods are not of stated quality within 3 days of delivery, in order to enable the Seller to investigate the complaint before the goods are returned to the Seller.  Any Warranties or conditions statutory or otherwise as to quality or fitness for the purpose except where specifically stated are excluded, and except as provided for in these conditions the Seller shall except no claim for the consequential loss, damage, injury or other liability.  Defects in the quality or dimension of any delivery shall not be grounds of cancellation for the remainder of the contract by the Buyer.  Any requests for warranty calls made by the buyer within the warranty period, either by Eastleigh Services engineers or the manufacturers appointed engineers will be chargeable where outside the scope of the manufacturers warranty conditions. Use of a domestic machine in a commercial environment is deemed outside the scope of warranty. Warranty does not apply to wear and tear, or if the product has been damaged or abused. Warranty does not apply to operator responsibilities such as cleaning of filters, issues due to water supply tap problems, external drains blocked, 

    Repairs: Unless otherwise stated on seller's quotations or documentation, a 3 month warranty applies to all repair work carried out. Only the repair work carried out is guaranteed, not the appliance as a whole. In the event that a fault to an appliance within a repair warranty is found to be caused by a different part or function of the machine not related to the original repair work, then the work will be chargeable.

    6. Specifications

    All descriptive specifications literature, drawings etc., submitted with the Sellers quotations are approximate only, as is the descriptive literature contained in any catalogue of the Seller, price list and other advertising matter.

    7. Delivery, Loss and Damage

    a) Delivery dates given by the Seller are estimates only and are not of any contractual effect.  For the avoidance of doubt, time shall not be of the essence with delivery.
    b) The Seller shall not be under any liability to the Buyer in respect of any failure to deliver on any particular date or dates for whatever reason, although every effort will be made so to do.
    c) The Seller will be entitled to make delivery by instalments.
    d) No claim under the above heading or for loss or damage to the goods will be accepted unless stated at time of delivery on carriers documentation and to Eastleigh Services office within 24 hours of delivery in writing or by fax. All goods received by the buyer must be inspected; it is the responsibility of the buyer to ensure goods are fully inspected.   No claims will be accepted where this procedure in not adhered to, or where goods have not been inspected on delivery. 
    e) Where delivery cannot be accepted by the Buyer at an agreed time, an additional cost will be made for the failure to take delivery and storage of goods where applicable.  Payment will be due from the date the attempted delivery was made.

    8. Returns

    Return of goods will be accepted only upon Eastleigh Services discretion and prior authority from a company Director. Any returned goods must be returned in their original packaging and unused. An administration charge may be made. All goods returned without authorisation or not in the above condition will be rejected and returned at the buyers cost.  Any goods cancelled or returned will be at the discretion of Eastleigh Services, charges may apply.

    9. Payment

    9.1 Payment (Account customers only)

    a) The agreed terms of payment shall be 30 days from the date of invoice unless otherwise agreed in writing between the Buyer and Seller and must be strictly observed. If any sum due there under is not paid in full by the due date or before such date and the Buyer is unable or unwilling to make such payment in full, then the Seller shall have the right to terminate the Contract forthwith.  Any queries or disputes relating to invoices must be notified in writing within 7 days of receipt of the invoice.
    b) The Seller reserves the right to charge interest at 2% per month on total invoice price from the date payment becomes due.

    9.2 Payment (Non-Account customers)

    a) Payment will be required in advance of all works carried out for customers without a credit account in place. At the Seller's discretion, some works may be authorised to be paid on completion of the work.
    b) Where card payments or authorisations are made online, the Customer agrees for the payment method to be securely stored by our payment processor (Stripe), and charged for future payments as per prices quoted at the time of job booking or subsequent quotation.

    10. Property

    Not with standing delivery and the passing of risk and solely for the purpose of securing payment of all monies due or to become due to the Seller by the Buyer on any account in the event of the Buyer entering into liquidation or having a winding up order made against it or a receiver and manager being appointed of its assets or income or any part thereof or in the event of the Buyer being an individual or individuals he or either of them committing any act of Bankruptcy or having any Bankruptcy petition presented against him or either of them.
    a) The goods shall remain the property of the Seller until payment has been made for the goods in full and for all other sums due before and after the date of delivery of the goods.
    b) Where full payment has not been made to the Seller and the Buyer uses the goods with other products the property of the goods shall be retained by the Seller in so far as such goods are identifiable.
    c) The Seller reserves the right to remove the goods from their present location where payment is not received by the due date.

    11. Indemnity

    The Buyer shall indemnify the Seller in respect of all actions, suits, claims and demands, charges or expenses in connection therewith for which the Seller may become liable in respect of the goods sold under the contract in the event that damage or injury have occasioned otherwise than by negligence of the Seller.

    12. Proper Law

    These conditions and the contract between the parties shall be construed and applied in accordance with the Law of England and the English courts shall have sole jurisdiction in any dispute relating thereto.
